WORKERS' COMPENSATION BENEFITS


The most common types of benefits recoverable due to work-related injuries under workers' compensation law are, as follows:


Medical Treatment

The workers compensation insurance provider is required to to provide all treatment “reasonable and necessary” to “cure or relieve” the symptoms and effects of an industrial injury at no cost at all to the injured worker.  Effective management of a case can result in a lifetime award for medical treatment.

Temporary Disability

While the applicant is recovering from the injury and in active treatment, he or she is entitled to two-thirds (2/3) of his or her average weekly wage up to a certain maximum amount that varies with the date of injury.  Under the new law, temporary disability is limited to two years (104 weeks), but certain strategies can often increase the period of benefits.

Permanent Disability

This is an entitlement to funds and compensation when an injury results in lasting residual symptoms and limitation.  The value of permanent disability (P.D.), however, is now measured by an imposed standard.  Securing this value depends on getting to the right evaluating physicians and securing a proper rating of the report.

Job Displacement Voucher

This is an entitlement to benefits that will provide education and retraining when permanent disability is found.
